FEATURES OF THE USE OF COMMERCIAL SOFTWARE FOR AUTOMATED CIVIL SYSTEMS IN THE CONTEXT OF CONDUCTING FORENSIC EXPERTISE IN UKRAINE

Abstract

The article highlights the features of using commercial software (SW) as part of automated systems (AS) for civilian purposes, taking into account the requirements that are put forward when conducting forensic expertise (expert research) in Ukraine. It is shown that the widespread use of commercial software products in the areas of public administration, medicine, transport, finance, and education leads to an increase in the number of litigation in which the object of research is software. Key problematic issues were identified: insufficient national methodological framework and regulatory framework, risks of using unlicensed versions, difficulty in confirming the authenticity of electronic data, lack of open source code. The need for unification of approaches (development of expert research methodologies/algorithms) of commercial software in forensic examinations and adaptation of international standards is substantiated. Directions for improving expert practice are proposed: development of methodologies/methodological recommendations, creation of mechanisms for certification of software products, harmonization with EU legislation. A conclusion is made about the interdisciplinary nature of the problem, combining legal, technical and organizational aspects.
