МІЖНАРОДНІ СТАНДАРТИ ПРОФЕСІЙНОЇ ЕТИКИ СУДОВОГО ЕКСПЕРТА ТА ЇХ РОЛЬ У ЗАПОБІГАННІ ЕКСПЕРТНИМ ПОМИЛКАМ: ПОРІВНЯЛЬНО-ПРАВОВИЙ АНАЛІЗ

Цей дослідницький проєкт має на меті визначити шляхом порівняння правових систем України, Німеччини та Польщі, чи існує зв’язок між застосуванням міжнародних етичних стандартів та типами експертних помилок, яких припустилися під час судово-медичної експертизи. Це буде досягнуто шляхом порівняння правових емпіричних методів з використанням загальнодоступних судових рішень за п’ятирічний період з 2020 по 2025 рік. Вибрана емпірична вибірка складається з 30 окремих судових справ, у яких було 47 ідентифікованих випадків експертної помилки; однак в одному висновку може бути більше одного ідентифікованого випадку експертної помилки, через що кількість випадків перевищуватиме 47. Частка когнітивних помилок порівняно з усіма помилками в емпіричній вибірці визначена на рівні 51,1 %, причому 29,8 % є методологічними, а 19,1 % – етичними помилками. За результатами дослідження, проведеного щодо рівня дотримання етичних принципів, було встановлено, що 38,3 % усіх випадків мали повну відповідність; 34,0 % усіх випадків мали часткову відповідність; і, нарешті, 27,7 % випадків мали порушення. Обсяг порушень за країнами показав, що Україна мала найбільшу кількість (23) порушень, далі йдуть Польща (14) та Німеччина (10), що свідчить про те, що різні юрисдикції мають різну практику застосування етичних стандартів. Статистичний аналіз продемонстрував наявність статистично значущої кореляції між рівнем дотримання етичних норм та кількістю зафіксованих помилкових експертних висновків. Результати показали, що навіть за умови дотримання етичних норм за допомогою формальностей помилкові експертні висновки все ще можуть виникати внаслідок когнітивних та процедурних впливів. Це дослідження має потенціал додати практичну цінність механізмам забезпечення якості щодо судово-медичної експертизи, а також допомогти у впровадженні етичних норм на практиці.
